Adversarial system

A legal process in which opposing parties present evidence and arguments to an impartial decision-maker, who determines the dispute.

Burden of proof: The obligation to establish a claim or fact to a specified level of certainty in a legal proceeding. It determines which party must persuade the decision-maker on disputed issues.
Inquisitorial system: A legal process in which a judge or other official takes an active role in investigating and developing a case. It contrasts with the adversarial system’s reliance on parties to present opposing cases.
Due process: Legal protections requiring fair procedures before the state deprives a person of life, liberty, or property. Meaningful opportunities to present and challenge a case are central procedural safeguards.
Common law: A legal tradition in which judicial decisions and precedent are major sources of law. The adversarial system is especially associated with common-law jurisdictions.
Cross-examination: Questioning a witness by a party other than the one that called the witness. It lets opposing counsel test testimony presented by the other side.
Hybrid legal system: A legal system combining procedures or institutions associated with more than one legal tradition. Some jurisdictions mix party-led presentation with stronger judicial investigation.
Access to justice: The ability of people to understand, use, and obtain fair outcomes from legal institutions. Unequal resources can make effective participation in party-led litigation difficult.
English legal system: The institutions and procedures through which law is made, interpreted, and applied in England and Wales. Its courts shaped procedures later adopted across many common-law jurisdictions.
Rules of evidence: Legal rules governing which information may be presented and considered in a proceeding. They set boundaries on the evidence parties can offer and challenge.
Alternative dispute resolution: Methods such as mediation and arbitration for resolving disputes outside ordinary court litigation. These methods can resolve disputes without a full adversarial trial.
