Australian Constitution

The Australian Constitution is the supreme legal framework establishing the Commonwealth of Australia, dividing powers between federal and state governments, and defining their institutions.

Federation of Australia: The 1901 formation of the Commonwealth of Australia by the union of six self-governing British colonies. The Constitution established the federation and allocated powers between its new Commonwealth and the states.
Section 51 of the Australian Constitution: The constitutional provision listing many subjects on which the Commonwealth Parliament may legislate. Its enumerated powers define much of the Commonwealth’s legislative reach.
Australasian Federation Convention: A series of 1890s meetings where colonial representatives debated and drafted proposals for Australian federation. Convention delegates shaped the draft that became the Constitution.
Unitary state: A state in which the central government holds ultimate constitutional authority over regional administrations. Australia’s Constitution instead entrenches authority at both Commonwealth and state levels.
Australian federalism: Australia’s system of government divides constitutional authority between the Commonwealth and state governments. The Constitution’s central design is its allocation of authority across two levels of government.
Section 109 of the Australian Constitution: The provision making valid Commonwealth law prevail over inconsistent state law to the extent of inconsistency. It resolves conflicts when federal and state legislation cover the same ground.
Australian constitutional referendums, 1898–1900: A sequence of colonial votes that approved the proposed Australian Constitution between 1898 and 1900. The draft required popular approval in the colonies before imperial enactment.
Parliamentary sovereignty: The principle that a legislature has supreme lawmaking authority and is not bound by a higher codified constitution. Australian Commonwealth and state parliaments are limited by constitutional rules enforced by courts.
Parliament of Australia: Australia’s national legislature, comprising the Crown, the Senate, and the House of Representatives. Chapter I establishes Parliament’s composition, powers, and lawmaking role.
High Court of Australia: Australia’s highest court, with authority to interpret the Constitution and decide federal disputes. Its decisions give practical meaning to constitutional provisions and limits.
