Common-law marriage

Common-law marriage is a legally recognized marriage formed without a civil or religious ceremony. Its requirements and availability vary by jurisdiction, commonly involving mutual agreement and conduct presenting the couple as married.

Marriage: A legally or socially recognized union that creates relationships and obligations between spouses. Common-law marriage is one way a jurisdiction may recognize a marriage.
Divorce: The legal dissolution of a marriage by a court or other competent authority. A valid common-law marriage generally must be ended through divorce, not simply by separating.
Domestic partnership: A legally defined relationship status that grants partners some rights without necessarily making them spouses. It may provide protections without creating the marital status claimed in common-law marriage.
English common law: A legal tradition developed in England through judicial decisions and precedent, later influencing many legal systems. The doctrine's name and historical development are tied to common-law legal traditions.
Full faith and credit: A constitutional rule requiring U.S. states to respect many public acts, records, and judicial proceedings of other states. Interstate disputes can turn on whether another jurisdiction must recognize a marriage validly formed elsewhere.
Mutual assent: An agreement in which parties express consent to the same terms or legal relationship. Many jurisdictions require both partners to intend to be married to each other.
Marriage certificate: An official record documenting a marriage, usually issued after a ceremony or registration. A couple may need a court finding or other evidence when no certificate records the marriage.

Canon law: The body of laws and regulations governing the Christian church and its institutions. Church rules historically shaped disputes over what made a marriage valid.
Conflict of laws: Rules for deciding which jurisdiction's laws apply when a legal matter connects to multiple places. A couple's residence, formation, and later proceedings may involve jurisdictions with different marriage rules.
