English Court of Chancery

The English Court of Chancery administered equity alongside the common-law courts, granting remedies such as injunctions and specific performance where common-law remedies were inadequate.

Equity (law): A body of legal principles and remedies developed to supplement the common law and mitigate its limits. Chancery was the English court in which equitable principles were chiefly administered.
Lord Chancellor: A senior British officeholder whose historical duties included presiding over the Court of Chancery. The Chancellor’s authority and staff formed the institutional center of Chancery.
Judicature Acts 1873 and 1875: British statutes that reorganized the superior courts of England and Wales into a unified Supreme Court of Judicature. The Acts ended Chancery’s existence as a separate court while preserving equitable rules and remedies.
Common law: A body of law developed through judicial decisions and procedural traditions, distinct historically from equity. Chancery’s jurisdiction arose partly because common-law remedies and procedures could be inadequate.
Injunction: A court order requiring a party to do a specified act or refrain from doing one. Chancery could restrain conduct when damages would not adequately protect a claimant.
Medieval English law: The legal institutions and practices that developed in England during the Middle Ages. Chancery emerged as royal justice expanded beyond the procedures of medieval common-law courts.
Supreme Court of Judicature: The unified system of superior courts established in England and Wales by the Judicature reforms. Its creation brought common-law and equitable administration into the same court system.
Writ (law): A formal written command issued by a court or authority, historically used to initiate or direct legal proceedings. Common-law access depended heavily on recognized writs, unlike Chancery’s more flexible bill procedure.
Specific performance: An equitable remedy ordering a party to fulfill a contractual obligation. Chancery used it when compensation could not adequately replace the promised performance.
Court of King's Bench: A central English common-law court that heard cases involving the Crown and serious civil and criminal matters. King’s Bench applied common-law forms while Chancery offered equitable relief.
