Criminal trial

A court proceeding in which the prosecution must prove a defendant’s guilt under the applicable standard of proof. A judge or jury determines the facts and returns a verdict.

Burden of proof: The obligation to establish a claim or allegation to a specified level of certainty. The prosecution bears this obligation, usually beyond a reasonable doubt.
Criminal charge: A formal accusation that a person committed a criminal offense. The charge identifies the alleged offense the prosecution must prove.
Bench trial: A trial in which a judge decides the facts and verdict without a jury. It replaces jury fact-finding with a judge’s determination.
Double jeopardy: A protection against being tried or punished again for the same offense after specified prior proceedings. A completed trial can limit the state’s ability to prosecute the same offense again.
Magna Carta: A 1215 charter that limited royal authority and influenced later legal protections in England and beyond. Its legacy is often linked to lawful judgment and limits on arbitrary punishment.
Presumption of innocence: The principle that an accused person is treated as innocent unless guilt is established through lawful proceedings. It places the risk of an unproven accusation on the prosecution.
Elements of a crime: The facts the prosecution must establish to prove a particular criminal offense. The verdict depends on whether the evidence establishes every required element.
Jury trial: A trial in which a jury determines disputed facts and returns a verdict. It assigns the central factual decision to a jury rather than solely to a judge.
Appeal: A request for a higher court to review a lower court’s decision for legal error. A party may challenge certain rulings or the judgment after trial.
Trial by ordeal: A medieval practice that treated the outcome of a physical test as evidence of divine judgment. It contrasts with adjudication through evidence and legal argument.
