Critical race theory

Critical race theory is an interdisciplinary framework developed by U.S. legal scholars to examine how laws and institutions produce or maintain racial inequality.

Structural racism: Racial inequality produced or sustained by interconnected institutions, policies, and social practices. Critical race theory examines how inequality persists through systems beyond individual prejudice.
Derrick Bell: An American legal scholar whose work helped establish critical race theory. His scholarship developed foundational arguments about racial reform and legal institutions.
Brown v. Board of Education: The 1954 U.S. Supreme Court decision holding state-mandated racial segregation in public schools unconstitutional. CRT scholars have examined the ruling’s limits and the later persistence of school segregation.
Liberalism: A political tradition emphasizing individual rights, legal equality, and limits on state power. CRT disputes whether individual-rights frameworks and formal equality alone can remedy structural inequality.
Critical race theory in education: The use of critical race theory to study how race and racism shape educational policies and institutions. This application became especially visible in disputes about teaching race in U.S. schools.
Racial formation theory: A theory of how social, economic, and political forces create and transform racial categories. It helps explain race as historically made and remade rather than biologically fixed.
Kimberlé Crenshaw: An American legal scholar who developed intersectionality and helped establish critical race theory. Her work named how antidiscrimination law can overlook overlapping forms of discrimination.
Voting Rights Act of 1965: A U.S. federal law prohibiting racial discrimination in voting and authorizing federal oversight of election practices. Its enforcement and subsequent restrictions provide material for studying law’s changing effects on racial power.
Color-blind constitutionalism: An approach to constitutional law that treats government use of racial classifications as presumptively illegitimate. This approach conflicts with CRT arguments that race-neutral doctrine can leave entrenched disparities intact.
Critical race feminism: A scholarly approach combining critical race analysis with feminist attention to gender and law. It extends CRT’s analysis to racialized gender relations and legal experience.
