Doctrine of discovery

A legal doctrine used by colonial powers to justify claims over lands inhabited by non-Christian peoples. It shaped European imperial law and continues to affect Indigenous land rights.

Terra nullius: A legal fiction treating land as unowned or available for acquisition, despite existing inhabitants or use. It offered another route to denying Indigenous peoples’ prior rights to land.
Romanus Pontifex: A 1455 papal bull granting Portugal rights to conquest and trade along parts of the African coast. It linked Christian authority to Portuguese expansion before the better-known American claims.
Indigenous land rights: The rights of Indigenous peoples to own, use, govern, and maintain relationships with their traditional lands. The doctrine has been used to subordinate these rights to claims of colonial sovereignty.
Conquest: The acquisition of territory through armed force and the defeat or subjugation of its prior government. Discovery claimed title through encounter and religious status, rather than openly through military victory.
Johnson v. M'Intosh: A 1823 U.S. Supreme Court decision holding that Indigenous nations could occupy land but not sell it directly to private buyers. Chief Justice John Marshall invoked discovery to define the limits of Indigenous land rights in U.S. law.
Dum Diversas: A 1452 papal bull authorizing Portugal to wage war against non-Christians and reduce them to perpetual servitude. Its language helped establish a religious rationale for conquest and enslavement.
Indigenous sovereignty: The inherent authority of Indigenous peoples to govern themselves and their territories. Discovery doctrine challenged this authority by assigning ultimate sovereignty to colonial states.
Effective occupation: A principle of international law requiring actual possession or administration to establish a territorial claim. Unlike discovery, it ties claims more directly to acts of control on the ground.
Aboriginal title: A legal right to land grounded in Indigenous peoples’ occupation and use before colonization. The doctrine recast this prior relationship as a limited right of occupancy.
Age of Discovery: The period of European maritime exploration and overseas expansion beginning in the fifteenth century. The doctrine developed amid the voyages and rival imperial claims of this period.
