Employment contract

An agreement establishing the terms under which an employee performs work for an employer, including duties, compensation, and conditions of employment.

Employee: A person who performs work for an employer within an employment relationship. The contract sets the terms governing this party’s work.
Offer and acceptance: The exchange by which parties express agreement to contractual terms. An employment contract may form when an employer’s offer is accepted.
Non-disclosure agreement: A contract restricting the disclosure or use of specified confidential information. Confidentiality obligations may appear within or alongside an employment contract.
Independent contractor: A self-employed service provider who operates outside an employer–employee relationship under applicable legal tests. Contractors use service agreements rather than employment contracts, though classification depends on the facts.
Employer: A person or organization that hires and directs employees. The employer offers the agreement and undertakes its contractual obligations.
Consideration: A legally recognized exchange of value required for forming a contract in some legal systems. Work and promised compensation can supply the exchange supporting the agreement.
Non-compete clause: A contractual restriction on certain work for competitors after an employment relationship ends. Some employment agreements seek to limit post-employment competition, subject to local law.
Fixed-term contract: An employment agreement that ends on a specified date or upon a defined event. It is a distinct form of employment contract with a limited duration.
Wage: Compensation paid to a worker for labor, commonly calculated by time or output. Pay is a central term of most employment agreements.
Implied term: A contractual term inferred from law, established practice, or the circumstances of an agreement. Some employment obligations apply even when they are not written down.
