Equitable remedy

An equitable remedy is court-ordered relief that addresses a legal wrong through means other than monetary damages, such as an injunction or specific performance.

Injunction: A court order requiring a party to do something or refrain from doing something. It is the principal form of equitable relief for stopping or preventing conduct.
Court of equity: A court historically applying equitable principles and remedies distinct from common-law courts. Equitable remedies developed in courts that could grant relief unavailable at common law.
Compensatory damages: Money awarded to compensate a claimant for losses caused by another party’s wrongful conduct. Damages are the usual legal alternative when monetary compensation can make the claimant whole.
Trade secret: Confidential business information that derives value from not being generally known and is subject to reasonable secrecy measures. Injunctions can prevent further disclosure or use of misappropriated trade secrets.
Specific performance: A court order requiring a party to perform a contractual obligation. It compels the promised performance when damages would not adequately replace it.
Equity (law): A body of legal principles developed to supplement strict common-law rules with discretionary remedies and doctrines. Equitable remedies arise from this body of principles and its limits on judicial discretion.
Punitive damages: Damages awarded to punish particularly wrongful conduct and deter similar behavior. Unlike equitable orders, these monetary awards punish rather than direct future conduct.
Land sale: A transaction in which ownership of real property is transferred in exchange for payment or other consideration. Courts may order specific performance because a particular parcel is not readily replaced by damages.
Declaratory judgment: A court judgment that establishes the parties’ legal rights without necessarily ordering action or awarding damages. It clarifies rights and can avert the need for coercive equitable relief.
Adequate remedy at law: A legal remedy, usually damages, sufficient to provide complete relief for a wrong. Courts commonly withhold equitable relief when ordinary damages can adequately address the injury.
