Hate crime

A criminal offense motivated in whole or in part by hostility toward a person’s actual or perceived membership in a protected group. Laws differ in which groups and offenses they cover.

Bias motivation: Hostility or prejudice toward a person because of actual or perceived group membership. A hate crime’s defining feature is the role this motivation plays in the offense.
Hate speech: Expression that attacks or demeans people based on group identity; its legal status varies by jurisdiction. Hateful expression alone is not necessarily a criminal offense or a hate crime.
Civil Rights Act of 1968: A United States federal law addressing housing discrimination and protecting specified rights in public settings. Its protections included federal provisions addressing interference with certain civil rights through force.
Victim impact statement: A statement describing how an offense affected a victim, submitted during legal proceedings. It can document the personal and community harms associated with bias-motivated offenses.
Protected class: A group characteristic that a law protects against discrimination or targeted harm. Hate-crime statutes specify which group characteristics can trigger enhanced liability.
Discrimination: Unequal treatment based on a characteristic such as race, religion, sex, or disability. Discrimination can be unlawful without involving a criminal offense or violence.
Hate crime legislation: Laws that define bias-motivated offenses or add penalties and enforcement powers for them. These statutes established the legal frameworks that now vary across jurisdictions.
Underreporting: The failure to report or record incidents that occur. Fear, distrust, or uncertainty about classification can leave hate crimes out of official data.
Sentencing enhancement: A legal rule that increases a sentence when specified aggravating circumstances are proved. Some jurisdictions use this mechanism to increase penalties for bias-motivated offenses.
Terrorism: Violence or threats intended to intimidate a population or influence government for political purposes. Some attacks overlap, but terrorism is defined by broader aims rather than protected-group hostility alone.
