Indigenous land rights

Indigenous land rights are legal and political claims by Indigenous peoples to lands, resources, and territorial authority, grounded in enduring relationships with ancestral territories and distinct systems of law and governance.

Indigenous peoples: Peoples with historical continuity with pre-colonial societies and distinct social, cultural, or political institutions. Their collective identity and continuity underpin many claims to ancestral lands.
United Nations Declaration on the Rights of Indigenous Peoples: A 2007 United Nations declaration setting international standards for Indigenous peoples’ rights. Its articles address lands, territories, resources, and consent to projects affecting them.
Mabo v Queensland (No 2): A 1992 High Court of Australia decision recognizing native title in Australian law. The decision rejected terra nullius as a basis for denying pre-existing land rights.
Terra nullius: A doctrine treating territory as belonging to no one before a state claims it. It was used to discount Indigenous law and occupation in colonial land acquisition.
Indigenous sovereignty: The inherent authority of Indigenous nations to govern themselves and their territories. Land claims often include authority to make decisions, not just ownership.
Native Title Act 1993: Australian federal legislation establishing a process to recognize and protect native title rights and interests. It shows how a national statute can create procedures for proving and negotiating claims.
Delgamuukw v British Columbia: A 1997 Supreme Court of Canada decision clarifying Aboriginal title and evidence of Indigenous oral histories. It shaped how courts assess title grounded in occupation before Crown sovereignty.
Fee simple: The broadest standard form of private land ownership in common-law systems. Its individual, alienable ownership model differs from many collective Indigenous tenure systems.
Aboriginal title: A common-law land interest arising from Indigenous occupation and systems of law before colonization. It provides one legal route for recognizing Indigenous relationships to land.
Treaty: A formal agreement between political entities that creates rights and obligations under law. Treaties may reserve land, establish boundaries, or define ongoing shared authority.
