Injunction

An injunction is a court order requiring a person or organization to perform a specified act or refrain from one. Courts use injunctions to prevent or remedy conduct when monetary damages alone are inadequate.

Preliminary injunction: A temporary court order preserving the parties’ positions while a case proceeds. It can restrain conduct before the court decides whether permanent relief is warranted.
Equity (law): A body of legal principles that supplements common-law remedies with discretionary forms of relief. Injunctions developed as a characteristic remedy of courts exercising equitable powers.
Copyright injunction: A court order restricting or requiring conduct to address infringement of copyright-protected works. Copyright cases often seek to stop continued copying or distribution.
Monetary damages: A financial award intended to compensate for legally recognized harm. Injunctions are sought when payment would not adequately prevent or remedy the injury.
Temporary restraining order: A short-term court order that restrains specified conduct, often issued before a full hearing. It can provide immediate protection until a preliminary-injunction hearing.
Specific performance: A court order requiring a party to perform a contractual obligation rather than pay damages. It is another equitable remedy that compels conduct instead of awarding money alone.
Patent injunction: A court order barring or requiring conduct in a dispute involving a patent right. It may prevent continued use of an invention found to infringe a patent.
Declaratory judgment: A court’s binding statement of the parties’ legal rights or obligations without necessarily ordering further action. Unlike an injunction, it can resolve uncertainty without compelling or forbidding conduct.
Permanent injunction: A court order imposing continuing or indefinite obligations after a final decision on the merits. It supplies lasting relief when the court finds ongoing restraint or action necessary.
Balance of hardships: A comparison of the practical harms each party would face if a court grants or denies relief. This factor helps courts assess whether preliminary restraint is justified.
