International Covenant on Economic, Social and Cultural Rights

A United Nations treaty that commits its parties to progressively realize economic, social, and cultural rights, including rights to work, education, health, and an adequate standard of living.

Progressive realization: A human-rights principle requiring states to advance rights over time using the maximum of their available resources. It explains how the Covenant treats obligations whose full fulfillment requires sustained resources and policy change.
International Bill of Human Rights: The collective name for the Universal Declaration of Human Rights and the two foundational United Nations human-rights covenants. The Covenant is one of the two treaties that, with the Declaration, form this framework.
United Nations Commission on Human Rights: A United Nations body established in 1946 that helped draft major international human-rights instruments. The Commission led the drafting work that produced the Covenant.
Right to education: A human right entitling everyone to accessible education without discrimination and requiring states to make education available. Article 13 sets out the Covenant’s most extensive education guarantees.
Civil and political rights: Rights protecting freedoms and participation in public life, including expression, political participation, and fair trial. They are commonly contrasted with the Covenant’s economic, social, and cultural rights.
International Covenant on Economic, Social and Cultural Rights reporting process: The process through which states report on measures taken to implement the Covenant and the Committee reviews their progress. State reports are the treaty’s central routine mechanism for scrutiny.
Universal Declaration of Human Rights: A 1948 United Nations declaration proclaiming a common standard of fundamental human rights. Its social and economic rights helped shape the Covenant’s provisions.
Cold War: The geopolitical rivalry between the United States and the Soviet Union and their respective blocs from the late 1940s to 1991. Cold War disagreements shaped the decision to draft separate covenants for different categories of rights.
Right to health: A human right to the highest attainable standard of physical and mental health, including conditions needed for health. Article 12 anchors the Covenant’s health obligations.
Justiciability: The capacity of a legal claim to be decided and remedied by a court or tribunal. Debates over justiciability often challenge the enforceability of the Covenant’s rights.
