Istislah

Istislah is a method of Islamic legal reasoning that considers public welfare when deriving rulings, especially where foundational texts do not specify a rule.

Maslaha: A consideration of benefit or welfare in Islamic ethics and jurisprudence. Istislah derives rulings by treating maslaha, public benefit, as a legal consideration.
Maliki school: One of the four major Sunni schools of Islamic jurisprudence, founded around the teachings of Malik ibn Anas. Maliki jurists became especially associated with using public welfare in legal reasoning.
Quran: The central religious text of Islam, regarded by Muslims as divine revelation. Claims of welfare-based reasoning are assessed against the Quran's legal and ethical guidance.
Public health: The organized protection and improvement of health across populations. Measures against epidemics can be defended through preventing widespread harm and preserving life.

Malik ibn Anas: An eighth-century Medinan jurist whose teachings became the basis of the Maliki school. His legal tradition is closely associated with the early use of welfare-based reasoning.
Hadith: Reports about the sayings, actions, and approvals of the Prophet Muhammad. Hadith reports supply legal evidence that can limit or shape an istislah-based ruling.
Quarantine: The separation of people or animals exposed to contagious disease to limit its spread. Quarantine illustrates a welfare-based response to infectious risk and communal safety.
Public interest: A shared benefit or concern considered relevant to the welfare of a community. Disputes over istislah turn on how public interest is defined and distinguished from private advantage.
