Jurisprudence

Jurisprudence is the philosophical study of law, including its nature, sources, authority, and interpretation. It examines what makes rules legal and how law relates to morality, society, and justice.

Legal positivism: A theory that identifies law through social sources rather than its moral merit. It separates the question of what law is from whether law is just.
Legal formalism: An approach that treats legal outcomes as derivable from established rules and principles through logical reasoning. It contrasts with approaches emphasizing discretion, social context, or judicial behavior.
H. L. A. Hart: An English legal philosopher whose work developed modern legal positivism and the concept of law as a system of rules. His account of primary and secondary rules became a central framework for analyzing legal systems.
Judicial review: The power of courts to assess whether government acts comply with a constitution or other superior law. It puts questions about legal authority and interpretation at the center of institutional practice.
Legal hermeneutics: The study of how legal meaning is interpreted through texts, contexts, and traditions. It develops jurisprudential questions about interpretation into a broader account of legal understanding.
Natural law: A tradition holding that law is connected to moral principles accessible through reason or human nature. It challenges the idea that legal validity can be wholly independent of morality.
Critical legal studies: A movement arguing that legal reasoning and institutions reflect political choices and reproduce social power. It challenges claims that law is neutral or that doctrine determines outcomes on its own.
John Austin: An English legal philosopher who defined law through commands issued by a sovereign and backed by sanctions. His command theory is an influential early version of legal positivism.
Statutory interpretation: The process by which courts determine the meaning and legal effect of legislation. It reveals how theories of meaning and judicial discretion shape legal outcomes.
Sociology of law: The study of law’s institutions, practices, and effects within society. It investigates the social settings and consequences that jurisprudential theories often seek to explain.
