Louis Brandeis

Louis Brandeis (1856–1941) was an American lawyer and Supreme Court justice known for defending privacy, free speech, and limits on corporate power. He was the first Jewish justice on the Court.

Samuel Warren: An American lawyer and legal scholar who coauthored the 1890 article “The Right to Privacy.” His partnership with Brandeis produced the influential argument for a legal right to privacy.
Olmstead v. United States: A 1928 Supreme Court case that upheld evidence obtained through wiretapping without physical trespass. Brandeis’s dissent argued that constitutional privacy must adapt to technological change.
Brandeis brief: A legal brief that supports constitutional arguments with social-science data and factual research. Brandeis used this approach in Muller to defend limits on women’s working hours.
Modern privacy law: The body of law governing privacy interests in personal information, communications, and private life. His early account of privacy became a touchstone for later disputes over surveillance and technology.
Felix Frankfurter: An American legal scholar and Supreme Court justice who advised Brandeis and later joined him on the Court. Their friendship and correspondence connected Brandeis’s judicial work to progressive legal scholarship.
