Medical device regulation

Medical device regulation is the system of laws, standards, and oversight processes governing medical devices’ safety and performance throughout their development, marketing, and use.

Medical device classification: A system that assigns medical devices to regulatory categories based on risk and intended use. Classification determines the evidence and oversight a device must satisfy.
Medical device: An instrument, apparatus, implant, software, or other product intended for a medical purpose, generally acting without its primary effect through pharmacological means. Regulatory obligations begin with whether a product meets this definition.
Conformity assessment: A process for demonstrating that a product meets specified legal or technical requirements. This is central to European Union device access, unlike the FDA’s authorization pathways.
Medical Device Amendments of 1976: US legislation that established a comprehensive FDA framework for medical device classification and premarket oversight. It created the modern statutory foundation of US device regulation.
International Medical Device Regulators Forum: A voluntary group of medical device regulators working to harmonize regulatory approaches internationally. Its work addresses fragmentation among national device requirements.
Premarket approval: A regulatory review required before certain products may be marketed, based on evidence of safety and effectiveness. This is the demanding US pathway for many high-risk devices.
Intended use: The purpose for which a product is designed, labeled, or promoted to be used. A device’s claims help determine its classification and regulatory route.
CE marking: A mark indicating that a product meets applicable European Union requirements for sale in the European Economic Area. It signals conformity under the European device framework.
Medical device safety: The condition of a medical device posing acceptable risks when used as intended or reasonably foreseeable. Regulation seeks to reduce device-related harm without eliminating all risk.
Medical device harmonization: The alignment of medical device rules and regulatory practices across jurisdictions. Harmonization could simplify global development while preserving local safeguards.
