Plaintiff

A plaintiff is a person or entity that brings a civil claim against a defendant in court. The plaintiff seeks a legal remedy for an alleged wrong.

Complaint (legal): A formal document that sets out a plaintiff’s claims and the relief sought. It ordinarily states the allegations that begin the plaintiff’s lawsuit.
Civil procedure: The rules governing how noncriminal disputes proceed through courts. It supplies the procedural framework within which plaintiffs bring claims.
Claimant: A person or entity that asserts a claim, especially in systems or proceedings using that term. Many jurisdictions use this word where others call the party a plaintiff.
Small claims court: A court or court division that handles lower-value civil disputes through simplified procedures. Individuals often bring claims there without the formalities of larger lawsuits.
Service of process: Formal delivery of legal documents that gives a party notice of a proceeding. It notifies the defendant that the plaintiff has brought a case.
Defendant: A person or entity against whom a legal action is brought. The defendant is the opposing party named in the plaintiff’s claim.
Prosecutor: A public official who brings criminal charges on behalf of the state. Unlike a plaintiff in a civil suit, a prosecutor pursues a criminal case for the state.
Personal injury lawsuit: A civil action seeking compensation for harm caused by another party’s alleged negligence or misconduct. The injured person typically acts as plaintiff seeking damages.
Burden of proof: The obligation to establish the facts or legal propositions required to prevail in a proceeding. The plaintiff generally must prove the elements of the claim.
Cause of action: A set of facts and legal grounds that entitles a party to seek judicial relief. It identifies the legal basis on which the plaintiff sues.
