Regulatory capture

Regulatory capture occurs when a public agency tasked with overseeing an industry instead advances the interests of that industry or another regulated group.

Revolving door: Movement of people between government roles and jobs in industries affected by government decisions. Officials’ prospects for industry employment can soften enforcement or shape decisions before they leave office.
George Stigler: An American economist whose work on regulation argued that industries can use political power to shape rules for their benefit. His 1971 theory gave regulatory capture its influential economic account.
Sam Peltzman: An American economist who developed an economic model of regulation as a response to competing political interests. His model broadened Stigler’s account beyond simple industry control.
Federal Communications Commission: An independent United States agency that regulates interstate and international communications by radio, television, wire, satellite, and cable. Its licensing and spectrum decisions expose how technical dependence and concentrated industries can shape oversight.

Information asymmetry: A condition in which parties to an interaction possess different amounts or quality of information. Regulators often depend on firms for technical knowledge, giving those firms influence over what rules seem feasible.
The Theory of Economic Regulation: George Stigler’s 1971 article arguing that regulation is often acquired and designed by industries for their benefit. This article set out the framework most closely associated with the modern capture concept.
