Socialist law

Socialist law is a legal tradition associated with states governed by Marxist-Leninist parties. It organizes law around socialist political aims, public ownership, and state direction of economic life.

Marxism–Leninism: A political doctrine combining Marxist class analysis with Lenin’s theory of party-led revolution and state power. It supplied the official theory used to justify socialist states’ legal order.
Communist party: A political party organized around communist ideology and the pursuit or maintenance of communist rule. Party leadership shaped legislation and the priorities of public institutions.
Russian Revolution: The 1917 upheavals that ended imperial rule in Russia and brought the Bolsheviks to power. The Bolshevik state built the first enduring legal system identified with socialist law.
Civil law (legal system): A legal tradition organized around codified statutes and systematic bodies of legislation. Socialist law borrowed civil-law structures while assigning them different political purposes.
Dictatorship of the proletariat: A Marxist conception of political rule by the working class during the transition from capitalism to communism. It framed socialist legality as an instrument of transitional class rule.
Socialist legality: The doctrine that state authorities and citizens should act according to laws serving socialist objectives. It expressed the tradition’s claim that socialist power should operate through law.
Bolshevik: A member of the revolutionary Russian faction led by Vladimir Lenin that seized power in 1917. Bolshevik leaders reshaped courts, property rules, and state authority after the revolution.
Common law: A legal tradition in which judicial decisions form a major source of law alongside legislation. Its emphasis on precedent contrasts with socialist systems’ stronger focus on legislation and state policy.
Public ownership: Ownership of assets by the state, a community, or the public rather than private individuals or firms. Socialist legal systems gave public ownership a central place in property law.
Procuracy: A state institution, common in socialist legal systems, that supervises legality and may prosecute crimes. Procurators monitored compliance with law across courts and government agencies.
