Universal jurisdiction

Universal jurisdiction is a state’s authority to prosecute certain serious crimes regardless of where they occurred or the nationality of the accused or victims.

Aut dedere aut judicare: A treaty-based duty to extradite an accused person or submit the case to domestic authorities for prosecution. This principle supplies a treaty route for prosecuting some crimes when the alleged offender is found in a state.
Pinochet case: The British House of Lords’ 1998–1999 proceedings on whether former Chilean president Augusto Pinochet could be extradited to Spain. The case tested whether a former head of state could claim immunity from torture charges linked to universal jurisdiction.
International criminal law: The body of international rules governing individual responsibility for crimes such as genocide, war crimes, and crimes against humanity. Universal jurisdiction is one way domestic courts enforce international criminal law.
Impunity: Exemption from punishment or accountability for unlawful conduct. Universal jurisdiction can offer a forum when territorial or national authorities will not prosecute.
Customary international law: International law derived from general state practice accepted as legally required. Disagreement persists over which crimes customary law permits states to prosecute universally.
Presence requirement: A rule requiring an accused person to be physically present in a state before its courts exercise jurisdiction. Many universal-jurisdiction laws require the suspect’s presence, limiting trials in absentia.
Arrest Warrant case: The International Court of Justice’s 2002 judgment on Belgium’s arrest warrant for the serving foreign minister of the Democratic Republic of the Congo. The Court addressed official immunity in a case involving Belgium’s asserted universal jurisdiction.
Territorial jurisdiction: A state’s authority to regulate conduct occurring within its territory. Unlike territorial jurisdiction, universal jurisdiction does not depend on where the crime occurred.
State sovereignty: The authority of a state to govern itself and exercise power within its territory. Foreign prosecutions may be criticized as interference with the sovereignty of the state where crimes occurred.
Crimes against humanity: Certain widespread or systematic attacks directed against civilian populations, involving specified acts and knowledge of the attack. Their customary-law basis for universal jurisdiction remains contested in some national courts.
