Vicarious liability

Vicarious liability is legal responsibility imposed on one party for another party’s wrongful act because of a relationship between them, such as employment or agency.

Respondeat superior: A doctrine making an employer liable for an employee’s torts committed within the scope of employment. This is the principal common-law route for holding employers liable for employees’ wrongful acts.
Employer liability: An employer’s legal responsibility for harms connected to its business or workforce. Vicarious liability is a central basis for employer responsibility for employee torts.
Direct liability: Legal responsibility for a party’s own conduct, rather than for another person’s acts. It distinguishes liability based on an employer’s own negligence from liability transferred through relationship.
Tort law: The body of civil law that provides remedies for wrongful acts causing injury or loss. Vicarious liability is a method of assigning responsibility within tort law.
Scope of employment: The range of conduct sufficiently connected to an employee’s assigned work for legal purposes. Courts use this boundary to decide whether an employee’s tort is attributable to an employer.
Automobile insurance: Insurance coverage that protects against financial losses arising from owning or using motor vehicles. Vehicle accidents by employees often raise questions about employer liability and insurance coverage.
Negligent hiring: An employer’s direct negligence in hiring an unfit worker when the resulting harm was reasonably foreseeable. Unlike vicarious liability, it depends on the employer’s own failure in selecting the worker.
Compensatory damages: Money awarded to compensate an injured party for losses caused by a legal wrong. The liable party may have to fund compensation even without personally committing the tort.
Independent contractor: A worker who controls the manner of their work less directly than an employee and is generally engaged for a result. Hiring an independent contractor usually avoids vicarious liability, subject to recognized exceptions.
Medical malpractice: Professional negligence by a healthcare provider that causes harm to a patient. Hospitals may face vicarious liability for malpractice by employed clinicians.
