Knowra Witness Witness A person who observes the signing of a legal document and attests that it occurred. A witness may help establish the document’s authenticity, but does not necessarily endorse its contents.
Signature : A mark, name, or other sign made to identify a person or indicate adoption of a document. The witness observes this act and may attest that the named signer performed it.
Last will and testament : A legal instrument that states how a person’s property and affairs should be handled after death. Many jurisdictions require witnesses to observe a will’s signing or acknowledgment.
Notarization : An official notarial act that records a notary’s completion of a legally authorized procedure. A witness may only observe signing, while notarization can include identity checks, an oath, or an official certificate.
Burden of proof : The obligation to establish a claim or assertion to the required standard of evidence. Witness evidence may help the party relying on a document meet that obligation.
Attestation : A formal statement confirming that a fact or act is true or has occurred. A witness’s signature records confirmation that the document was signed in their presence.
Deed : A formal legal instrument that creates, transfers, or confirms an interest in property. Witnessing may be required for a deed’s execution, depending on the jurisdiction and document type.
Signing agent : A person who oversees the completion and signing of documents, commonly in real-estate transactions. A signing agent manages a signing appointment; that role does not automatically make the person a legal witness.
Document forgery : The creation, alteration, or use of a document with intent to deceive. A credible account of signing can help distinguish genuine execution from a forged signature.
Notary public : A public officer authorized to perform specified legal formalities, including verifying signatures and administering oaths. A notary can serve as an official witness while also performing identity and recordkeeping steps.
Power of attorney : A legal authorization allowing one person to act on another’s behalf. Some powers of attorney require witnesses, notarization, or both to take effect.
