Legal realism

Legal realism is an approach to law that studies how judges and other legal institutions actually make decisions, emphasizing practical effects, behavior, and social conditions over rules alone.

Legal formalism: An approach that treats legal outcomes as deductions from established rules and principles. Legal realism rejects the idea that rules alone reliably determine judicial outcomes.
