Lustration

Lustration is the screening or removal of public officials because of their involvement with a former authoritarian regime’s security services. It is a transitional-justice measure intended to protect democratic institutions and address the legacy of repression.

Transitional justice: The ways societies address mass human-rights abuses during transitions from conflict or authoritarian rule. Lustration is one institutional response to abuses and compromised public institutions inherited from authoritarian rule.
Czechoslovak lustration law: A 1991 Czechoslovak law that barred specified former Communist Party and security-service affiliates from certain public positions. It became an early and influential legal model for screening officeholders after communist rule.
Democratic consolidation: The process by which democratic institutions become stable, accepted, and resilient against authoritarian reversal. Lustration aims to reduce the influence of officials associated with authoritarian institutions.
Decommunization: Policies and social changes intended to dismantle communist institutions and symbols after communist rule. Lustration is one part of the broader effort to reshape institutions and public life after communism.
Criminal prosecution: A formal legal process in which the state seeks to prove that a person committed a crime. Unlike prosecution, lustration can impose office restrictions without establishing criminal guilt.
Vetting: A formal assessment of a person’s suitability for a role, often based on conduct, qualifications, or security risks. Lustration applies vetting to public office, using past ties to security services as a criterion.
Polish lustration: Poland’s process of requiring specified public figures to declare past cooperation with communist-era security services. Its declaration-based approach differed from systems that automatically excluded people based on records.
Collective memory: The shared ways a society remembers and interprets its past. Disclosure and screening shape how societies publicly remember collaboration and repression.
Collective guilt: The attribution of responsibility to members of a group for actions associated with that group. Lustration raises this concern when past affiliation is treated as proof of individual wrongdoing.
Truth commission: A temporary body that investigates patterns of past abuses and publishes findings, often outside ordinary criminal courts. Truth commissions seek an account of abuses, while lustration focuses on eligibility for public roles.
