Maslaha

Maslaha is consideration of public welfare or benefit in Islamic legal reasoning. It can support rulings when they serve recognized purposes of Islamic law and do not conflict with authoritative texts.

Maqasid al-Sharia: The purposes Islamic law seeks to protect, commonly including religion, life, intellect, lineage, and property. Maslaha is often assessed by whether a proposed ruling advances these legal purposes.
Maslaha mursala: A public interest not specifically affirmed or rejected by a revealed text, used by some jurists in legal reasoning. This is the form of maslaha most directly associated with deriving rulings for unaddressed cases.
Malik ibn Anas: An eighth-century jurist of Medina and founder of the Maliki school of Islamic law. Maliki jurisprudence became especially associated with using public interest in legal reasoning.
Istishab: The presumption that an established legal state continues unless evidence proves it has changed. Unlike maslaha's appeal to benefit, istishab preserves an existing rule or status by default.
Usul al-fiqh: The discipline that studies the sources and methods used to derive Islamic legal rulings. Maslaha is one method debated within this broader framework of legal reasoning.
Istislah: A method of legal reasoning that derives rulings by considering public interest not settled by specific texts. It names the juristic procedure through which maslaha can guide a ruling.
Al-Ghazali: An eleventh-century Muslim theologian and jurist who systematized influential accounts of law's purposes. His treatment connected welfare to protection of essential human interests.
Nass: An explicit textual statement in Islamic sources that bears directly on a legal question. Maslaha is generally constrained where a clear authoritative text settles the matter.
Qiyas: Analogical reasoning that extends a ruling from an established case to a new case sharing its effective cause. Jurists compare maslaha with analogy when explaining how new rulings can be derived.
Sadd al-dhara'i: The legal principle of blocking otherwise permissible means when they are likely to lead to prohibited harm. It shows how preventing harm can constrain or complement welfare-based reasoning.
