Confiscation

Confiscation is the seizure of property by public authority as a legal penalty or administrative measure. It transfers control or ownership without the owner’s consent.

Forfeiture: Forfeiture is the loss of property or rights as a consequence of wrongdoing or failure to meet a legal obligation. Many legal systems use forfeiture to impose confiscation as a penalty.
Seizure: Seizure is the taking of possession or control of property, often temporarily and pending legal proceedings. A seizure may precede confiscation but does not itself necessarily transfer ownership.
Roman proscription: Roman proscription was a public listing of people marked for execution and the seizure of their property. It shows confiscation used alongside political purges in the late Roman Republic.
Asset recovery: Asset recovery is the process of identifying, freezing, and returning or repurposing assets linked to crime or corruption. Confiscation can recover illicit wealth for victims or public use.
Money laundering: Money laundering is the process of disguising the criminal origin of assets to make them appear legitimate. Confiscating proceeds can remove the financial gains that laundering attempts to conceal.
Civil forfeiture: Civil forfeiture is a legal process that allows authorities to seize property alleged to be connected to unlawful activity. It permits confiscation through proceedings against property rather than criminal conviction of its owner.
Eminent domain: Eminent domain is the government’s power to take private property for public use, typically with compensation. Unlike punitive confiscation, eminent domain ordinarily requires compensation for the taking.
Dissolution of the Monasteries: The Dissolution of the Monasteries was Henry VIII’s suppression of English monasteries and transfer of their property to the Crown. The Crown’s seizure of monastic lands demonstrates confiscation on a large institutional scale.
Restitution: Restitution is the restoration of property or compensation to someone harmed by an unlawful act. Restitution can reverse an earlier confiscation or direct recovered property to those harmed.
Sanctions: Sanctions are restrictive measures imposed by governments or international bodies to influence conduct or enforce policy. Sanctions regimes may authorize blocking or confiscating assets linked to designated persons.
